I'm throwing in the towel and giving up trying to fight every agency out there in hopes of getting a little bit of gold. I've been cited for everything under the sun. Some of the violations were valid such as the ones in which I was cited for having improper labels on drums....drums were labeled apple juice and actually contained concentrate gold that was obtained though mechanical means hence no chemicals where used to obtain them. To the Forestry demanding I install a covert which would allow storm water to drain into my settling pond and then being told by the water board that I could not have storme water go into the pond. There's a whole slue of violations from the health department to the state to the county to the forestry and the list goes on and on....I really don't understand how anyone intends on making a living with all these regulations many of which contradict each other. At one point the forestry kicked out the caretaker and soon after which someone illegally dumped hundreds of tires that I had to pay to get rid of and stole some of my equipment and raped other pieces for the metal....Sorry for making this such a long rant...But I get the feeling that I'm getting kicked around and I'm fed up with it...I don't want to take the government to court for only god knows how long that will take and in the meantime I'll be stuck doing next to nothing so is there any other option? Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts Report Post	hi marketbarron that's what this forum is for .... sounds like the probloms i hear everyday from miners... parks shuting down mines, resorce roads, permits ,first nations, the list goes on... CMA and other associations, through the BCPMA are trying to make changes... Minister for the state for mining in BC, Gorden Hogg says he wants to make it easyer... but they want to be sure that changes made to placer mining come from the industery has a whole... like i keep saying all placer miners need to join an association and come to meetings... and get your issues on the table.... .... thanx for joining the cgma board and look forward to more posts .....jim

A politician, actually. Wants to abolish all mining. The proposed bill reads like a nightmare to miners. It's another law written by lawyers for the benefit of nobody except,........,the lawyers. I am no lawyer but I do know that Enforcement types can only operate within the law. Without knowing the specific charges you face it is hard to offer any insite to you. Did you have a valid work permit? As far as I know there is no offense for not labeling concentates in a drum but it could be an offense if the drum contained chemicals marked concentrates somewhere in the Dangerous Goods Act. It is an offense to improperly store dangerous chemicals either in the Dangerous Goods Act or under the mining safety rules. The labeling charge you mentioned sounds like they are chicken s**t charges and that you may have gotten them pissed off at you. If the Govt withheld a work permit THEY ARE IN VIOLATION OF THE LAW! Criminal Code Canada sec 337. The Supreme Court of Canada has rulled on these permits and licences in the Morgenthaler Case. The government cannot unreasonably whithhold a permit or licence they have a duty to issue within a reasonable time. THIS IS VERY IMPORTANT!!! ALL COMUNICATION BETWEEN YOU AND THE GOVERNMENT SHOULD BE IN WRITTING AND VIA REGISTERED MAIL!! This is your proof that the govt was made aware of your demand for work permits, authorizations to dicharge and for release of bonds!!! or whatever from the govt. 337 of the code is specificly designed for getting things that are yours back from a govt agency. If you have been charged plead not guilty, ask for a court appointed lawyer to defend you. Generally speaking you get what you pay for. I hope that this offers you some help. Cheers, John
